Effective from 1 October 2004, it was a legal requirement for all organisations to follow minimum disciplinary, dismissal and grievance procedures. These statutory procedures amount to a minimum standard that must be followed by all employers and employees. Failure to follow the statutory procedures by the employer prior to dismissal will render that dismissal automatically unfair. Employers will pay a potential increase in compensation of between 10-50% if the procedures are not followed.
